Will you be making it known that you will sue them if the ordinance passes?

Huntington Beach passed a version of the OC ordinance some time ago, in late 2011. This Monday, they intend to amend the ordinance that is already on the books. They are voting to add a provision that you must have written permission from their Chief of Police to enter city parks, etc. Just like the OC County ordinance.
Just. Plain. Stupid.
The OC ordinance was already declared pre-empted by existing state law, therefore unconstitutional. It is under review by the California Court of Appeal.
When I spoke at the Huntington Beach City Council meeting on May 17, 2011 in opposition to their ordinance, I got a STANDING ovation from members of the audience behind me. I said this:
“Protecting the Constitution of the United States protects everyone, including children. But when you start making exceptions to the Constitution, eventually the exceptions become the rule, and then we lose order.”
I cannot be at the HB City Council meeting this Monday, February 4th at 6pm to stand with Janice and California RSOL.

I am glad you are bringing this up, as the point of modifying the ordinance also eludes me. They are doing all this just to end up with an ordinance that has already been shot down once as unconstitutional.
HB is one of the 4 OC cities that is being sued. Will this amendment have an impact on the lawsuit? The City of Lake Forest did the sensible thing – both financially and legally – and repealed.
What is the point of this modification?

My best guess is that HB is trying to cozy up to the Orange County DA. Why? I don’t know. Only time will tell. Having said that, they are placing a large bet on a long shot. As Jeffrey stated above, one appellate court has already ruled that the Orange County ordinance is preempted by state law. If the HB law is just the same as the county ordinance, it will be ruled preempted as well.

I have been very patient with many of these city councils. So, I look forward to presenting before the Huntington Beach city council tomorrow. It’s a family thing.
